My letter to the Department of Revenue!

First of all, who do they think they are losing records and then demanding proof that we filed such records with them?

Dear Sir/Madam,

The letter you have sent dated July 18, 2016 titled, 'Notice and Demand to File' is not only perplexing but egregious. I'm not sure how your records suddenly show that we did not file a 2014 tax return, albeit we owed $59 to the [State] Department of Revenue that year, paid for with check no. [such and such]

I will not be filing any amended or secondary return, as we filed an original return in the early months of 2015 and sent payment owed prior to the April 15, 2015 deadline. Your demand is null and void, or as by those definitions not valid. It does not “(of an argument or point) hav[e] a sound basis in logic or fact; reasonable or cogent.”

If you choose to calculate the tax that we paid as unpaid and so choose to charge penalties and interest based on information that you apparently do not have or show record of, then we will choose to not pay such charges, interest and penalties based on the emptiness of information you do have. It seems more feasible that you have misplaced, lost or destroyed what we transmitted, which should serve to alarm us as to the filing and care-taking of sensitive information you hold about us.

I have given this matter my immediate attention as so urged. It would be advisable that your departments be more diligent and responsible and accountable for the private and confidential information we transmit to you annually.

along with our paper method of payment, which apparently managed to clear despite all other documentation being shown as never received. It's hard to imagine documents being separated while sealed in an envelope, so I'm only left with the possibility that the tax return was lost, misplaced or destroyed while the payment accompanying the return managed to evade the same fate.

I more concerned about our information missing than the payment they deposited (which is not even being contested). They are contesting the 'missing' tax return, therefore they can be presumed to have misplaced, lost or destroyed what we transmitted via mail service.

Did you submit electronically or by mail? If by mail, the USPS could be at fault and not the state tax "service". At any rate, a cancelled check would be proof that they got the filing.

The last letter I got from one of the revenuers was from the IRS saying that I didn't claim a deduction that they thought I was entitled to. Go figure. So I went back to H&R Block (that I paid $300+ to do my taxes) and showed them the letter. After much hemming and hawing, they admitted that the IRS was right and that I was entitled to another $112 by their calculations. The IRS said I was entitled to $136. H&R resubmitted my taxes and after many months I got a check for--$136.

You are right on all accounts, and I hope the IRS drones that read your letter realize that...but I can also imagine the sh-t storm that they can unleash because you had the temerity to challenge their demand.

I'm hoping the nose-tweaking you just gave them will hold them at bay. But an IRS bureaucrat with a sore nose is one of the most dangerous animals on the planet. Good luck.

...the populace is JUST TOO IGNORANT, MISINFORMED or APATHETIC to change anything.

Everyone thinks that:

There are only TWO political parties to vote for in our presidential (and other) elections,

There is no way to end the IRS,

There is no way to change the congress,

BUT THERE IS, and WE have the power in EVERY ELECTION to CHOOSE ANYONE OTHER than a republican or democrat.

I tell people this;
If every American who is disgruntled with 2-party politics simply voted for a THIRD PARTY, we would wake up the next morning with a NEW PRESIDENT who was NOT a republican or democrat.

But even after I say this, most people shrug their shoulder and say it's impossible.

So THIS COUNTRY DESERVES WHAT IT HAS.

The only shame of it is that those of us who DO love liberty, and DO try to change things, are so outnumbered that we are stuck with the same corrupt system as are those who truly deserve it.
