Amendment 2

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

“We the People” are the Militia. The 2nd amendment is not only for “We the People” to defend ourselves from people that will act criminally against us. Nor is it just to provide food for our table, nor is it just for sport.

The Second Amendment is to protect “We the People” from a tyrannical government. The Second amendment is what gives "We the People" the ability to ensure all our other rights reaffirmed by the constitution are not violated by the government. As years go by we see how the governments, from local to Federal are chipping away our rights that are reaffirmed by the constitution.

Firearms are not the problem, the violent nature of people in the United States is the problem. The government is at top of the list with its violence, shooting people because they are scared, killing innocent people with drones and other acts of violence in the name of “keeping us safe”. Locking up people for what they choose to put in their own bodies.

Our 4th amendment rights are constantly being violated by the government of all levels. The Forth Amendment states: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

When we go into a public building or public property that is owned by “We the People” or we attempt to fly on a privately owned commercial aircraft we are unreasonably searched and told we can’t exercise our right of self defense and our right to travel."The right to travel is a well-established common right that does not owe its existence to the federal government. It is recognized by the courts as a natural right." Schactman v. Dulles 96 App DC 287, 225 F2d 938, at 941, (http://www.apfn.org/apfn/travel.htm ) The government “claims” its for our protection, but why is that we can’t protect ourselves in public building. What is the government afraid of?

Remember the words of one of our founding fathers: On Nov 11, 1755, Franklin wrote: "Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.”

History shows with Hitler and other suppressive leaders and governments the first thing that these tyrants want to do is take away a persons way to resist a tyrannical leader or government. “We the People” must have the ability to defend and defeat an ever increasing tyrannical government. The government knows that it can’t allow “We the People”, who is supposed to be the boss of the governments, to be able to defend our rights affirmed by the constitution.

“We the People” should do this peacefully, but remember the words of John F. Kennedy “Those who make peaceful revolution impossible will make violent revolution inevitable.”

As the government keeps on tighting the noose around “We the Peoples” neck with unlawful “laws” We must take a stand. Article one, section eight of the U.S. Constitution, http://constitution.findlaw.com/article1.html gives The U.S. congress 17 items that the US government is responsible for.

Article Two of the US Constitution gives the Executive branch, The President and his staff the Authority to Execute or enforce the 17 areas of law that Congress has Authority to pass. Almost, if not all, executive departments are unconstitutional, they do not come under the 17 items of law that the congress is authorized to make.

“We the People” must start challenging the unlawful “laws” The Supreme Court has ruled: “All laws which are repugnant to the Constitution are null and void.” Marbury vs. Madison, 5 US (2 Cranch) 137, 174, 176, (1803). Of course “The system” is rigged by the government so a person has to spend money to “defend” oneself whenever the government say you are in violation.

The government and government employees as well as elected official has been granted immunity to not be charged civilly for violations of a person’s rights.

In my opinion at least these Six things need to be done: 1) remove immunity from all government departments, government employees, including elected officials. 2) Every one of “we the People” have standing to challenge any law that is passed when we believe it is Unconstitutional. 3) The government must reimburse attorney fees, loss wages, and all other costs that a defendant incurs when found “not guilty” of an alleged crimes, including infractions. 4) The person who arrests or charges a person with an alleged crime must pay a portion of the cost in number three. 5) a government complaint board made up of non-government employees needs be established with the authority to be able to charge a government employee and elected officials with a crime. A non governmental judge and prosecutor court needs to be established to try the defendant under common laws and common law rules of procedures. That all verdicts will be handed down by a jury including punishment. Any government employees who is found “guilty” of violating the Constitution of state or US no longer hold a government job. 6) All juries must be informed of Jury nullification.

I believe that these six things will help hold government accountable. too many government departments and employees forget they are public servants and try and take on the role of public masters forgetting they are public servants.

All courts should be required to try a defendant under common law and under common law rules of procedure. No longer will a person need to be a member of the private attorney’s union know as "the BAR" to be able to represent another person in court. All courts shall have the same rules. All courts must allow video and audio recording in the courtroom.
